Terms of Service


Welcome to EAR (Essential Automation Resource). By accessing or using our services, you agree to the terms and conditions outlined in this document (the "Agreement"). This Agreement governs your use of EAR’s automation and business solutions, including its AI-powered services, integrations, and technical support.


EAR is a product developed by SitioUno, a trusted provider of software solutions with over 22 years of experience. Please read these terms carefully before using our services.

EAR provides a suite of business automation services, including but not limited to:


AI-driven virtual assistants.

Integration with ERP systems such as Odoo.

Multi-channel communication management.

Custom web and mobile application development.

IT advisory and consulting services.

3.1 Account Registration

To use EAR, you must create an account and provide accurate information. You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted under your account.

3.2 Acceptable Use

You agree to use EAR’s services only for lawful purposes. Prohibited activities include:

Misuse of the platform for illegal or abusive purposes.

Sharing sensitive data without ensuring compliance with applicable data protection laws.

3.3 Service Limitations

EAR strives to deliver uninterrupted services. However, certain factors beyond our control (e.g., force majeure, network issues) may result in temporary downtime. EAR is not liable for such disruptions but will work to restore services promptly.

4.1 Subscriptions

EAR services are offered on a subscription basis.

Payments must be made according to the agreed billing cycle.

4.2 Late Payments

A late payment fee of 15% of the overdue amount will be applied after 21 days of non-payment.

If payments are overdue for 60 days, EAR reserves the right to suspend services and may refer the matter to a debt recovery agency.

4.3 Taxes

All subscription fees are exclusive of applicable taxes, which are the sole responsibility of the client.

5.1 Termination by Client

Clients may terminate their subscription by providing written notice 30 days before the next billing cycle.


5.2 Termination by EAR

EAR reserves the right to terminate accounts for:

Breach of terms.

Non-payment of fees.

Abuse or misuse of the platform.


EAR’s liability is limited to 50% of the total amount paid by the client in the 12 months preceding the claim. EAR is not liable for indirect damages, such as loss of profits or data.


This Agreement is governed by the laws of the United States, and any disputes will be resolved in the courts of Miami, Florida.


Privacy Policy


EAR is committed to protecting your privacy. This Privacy Policy explains how we collect, use, and safeguard your information.

EAR collects data to provide and improve its services. This includes:


Personal Information: Name, email address, phone number, and payment details.

Usage Data: IP addresses, browser type, and activity logs.

We use your data to:


Deliver EAR services.

Enhance user experience through AI-powered analytics.

Communicate updates and promotions (with opt-out options).

EAR may share data with trusted third parties for service delivery, such as:


Hosting Providers: Google Cloud Platform (GCP).

Payment Gateways: Secure third-party processors.

We do not sell or rent your personal data to third parties.

EAR employs robust measures to protect data, including:


SSL encryption for all communications.

Regular security audits and vulnerability assessments.

6. Data Retention

Data is retained as long as necessary to provide services. Clients may request data deletion upon account termination.


Frequency: EAR production builds are backed up every 24 hours.

Retention:

Daily backups retained for 7 days.

Weekly backups retained for 4 weeks.

Monthly backups retained for 3 months.

Scope: Development and staging builds are excluded from backups.


Additional Policies


1. Hosting Locations

EAR uses Google Cloud Platform (GCP) data centers in:

Americas: Iowa, United States.

Europe: Belgium.

Asia: Mumbai, Singapore.

Oceania: Sydney, Australia.

Note: Data center locations may change without prior notice due to hosting provider updates.


2. Hosting Specifications

EAR instances are dynamic and may migrate across servers during maintenance or upgrades. Specific server details are non-contractual.

EAR is committed to providing:


99.9% network uptime.

Tier-III data center hosting for reliability.

Disaster recovery protocols with regularly tested backups.




EAR offers custom development services, including:

Web and mobile app creation for Android and iOS.

Integration with third-party APIs.

Database migration and interoperability with existing platforms.

Custom solutions are billed separately and require a defined scope of work.





Invoices are payable within 21 days.

Services are subject to termination for late payments.

Pricing is based on user count and selected subscription plans.
